Sometimes I think it’s really too bad…

that “He needed killin'” isn’t really a valid defense in this state:

A Texas man has been charged with murder in the fatal shooting at a crash scene of a suspected drunken driver who authorities say plowed into his sons as they helped push their family’s broken-down pickup truck along a dark, narrow, rural road.

First thing I thought? “Give that dude a medal and a key to the city.” I can’t say for sure, but I bet you most if not every parent who’s had a kid killed in such a horrific manner has fantasized about doing something like that. It’ll be interesting to see what happens to this guy, for sure.

    Had he not walked to the house to retrieve a firearm and apparently the drunk wasn’t a threat, I would agree he should walk free.

    Given the grief over his loss, I think probation is an appropriate response. It would be very difficult for someone to argue the man is a continuing threat to society.

    I do think that jury nullification needs to be explained before the trial starts. Let a group of his peers decide if the charges are valid.
